Parcel machines only for InPost, Polish Post application rejected

The Adjudicating Chamber of the Patent Office has rejected the application of Poczta Polska for a declaration of invalidity of the word and trade mark Paczkomat® . It thus confirmed that the company entitled to use this mark is InPost - the leader in modern logistics for e-commerce in Poland - which is the co-creator of the success of this universal device for receiving and posting of consignments .
Poczta Polska requested the invalidation of the Paczkomat® mark as it argued that this mark was not suitable for registration with the Patent Office because the word was not distinctive - it is not original - which is required for the registration of a new trade mark. Moreover, Poczta Polska argued as an argument that the word Paczkomat® itself only describes the features of the device and as such is not suitable for registration. The Office rejected this argument and found that the word Paczkomat® is both original and unique, thus upholding the registration of this mark in favour of its existing owners.
"This is very good news, no one without our permission will now be able to use the word Parcel Machine ® . This proves that Poland is a state under the rule of law which protects the intellectual output of its citizens and companies. However, I am far from triumphalism. I believe that Polish companies should cooperate at least at home, as is the case with companies from other countries such as Germany, France and Italy, because the competitive pressure of large multinationals is enormous". - said Rafał Brzoska, founder and CEO of Integer.pl Group, to which InPost S.A. belongs.
Brzoska adds that he has stressed on various occasions that competition between entities should take place not in court but in the market in the form of the quality of services and the prices offered for them. "However, where they can, companies should work together using possible synergies." - emphasised Rafał Brzoska.
